Mr. Halder, learned advocate appearing for the petitioner after some arguments prays for leave to withdraw the revisional application. Mr. Bhattacharya, learned senior advocate representing the opposite parties submits that this revisional application is not maintainable, as the order impugned is an appelable one.

In view of the settled position of law and also in terms of the submission made by the learned advocate for the petitioner, the revisional application CO. 3284 of 2023 is dismissed as withdrawn with liberty to the petitioner to approach before the appropriate forum in accordance with law.

The petitioner will be at liberty to take back the original certified copy upon furnishing a photocopy of the same.

Urgent certified photo copy of this order, if applied for, be given to learned advocates for the parties upon compliance of all requisite formalities.
