The appellant was convicted and sentenced by the learned Additional Sessions Judge, Nabadwip, Nadia in connection with Sessions Case No.03(09)17 arising out of Sessions Trial No.04(Nov)17 and sentenced to imprisonment for commission of offence under Section 436 of the Indian Penal Code for rigorous imprisonment for a period of five years and to pay fine of Rs.5,000/- i.d. S.I. for five months.

The genesis of the case relates to Nabadwip P.S.Case No.339 of 2017 dated 23.08.2017.

Learned advocate appearing for the State has submitted a report prepared by the Superintendent, Krishnagar District Correctional Home, Nadia. The said report encloses a remission order passed in favour of the present appellant wherein it has been recorded that the appellant was released from the Correctional Home on 15.08.2022 after being granted remission under Article

161 of the Constitution of India by His Excellency, the Governor of West Bengal.

Since the appellant has been granted remission, learned advocate appearing for the appellant do not want to proceed with the merits of the appeal.

Accordingly, CRA 653 of 2019 is disposed of.

Pending connected application, if any, is consequently disposed of.
