A report has been submitted by the ld. Public Prosecutor, which has been prepared by the S.I. of Police, Bizpore P.S., Barrackpore Police Commissionerate, which be kept with the record.
According to the report, the said documents have been collected and the records are reconstructed. The only issue, now left, is the appointment of the ld. Public Prosecutor concerned for conducting the case. The Legal Remembrancer of the West Bengal is directed to engage a Public Prosecutor, if not already engaged. On the next date, the ld. Public Prosecutor so engaged for the purposes of this case, would be present before the ld. Trial Court.
The case is of the year 1999, as such, the ld. trial Court, would see to that the charges are considered at the earliest preferably within a period of one month from the next date so fixed. Thereafter, a schedule be fixed on three dates and, a schedule shall also be fixed on each and every month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. If any witness is not available, then, direct communication would be made with the Deputy Commissionerate in-charge in respect of Barrackpore Police Commissionerate so that the availability of the witnesses and a compliance report can be submitted within the earliest possible time.
All materials, documents and exhibits be produced by the ld. Public Prosecutor for examination of the witnesses.
With the aforesaid observations, CRR 3773 of 2022 is disposed of.
Pending application, if any, is also disposed of. The Registrar (Judicial), High Court, Calcutta is directed to communicate a copy of this order to the legal remembrancer of West Bengal.
The officer, who is representing the Bizpore P.S. is present in Court, his further appearance for the day is dispensed with.
