Petitioner has approached this Court as there was inaction on the part of the Officer-inCharge of Shyampur Police Station. Petitioner complains that a padlock has been affixed and obstruction created for carrying on the business at the shop premises which was leased out to him by the private respondents. To that effect, title suit no. 165 of 2016 has been pending before the learned Civil Judge (Junior Division), Uluberia.

Petitioner has also approached the learned ACJM, Uluberia under section 175(3) of the BNSS. Having considered that the criminal court has dismissed the said application and the civil

court is in seisin of the issue, for breach of order of the civil court, petitioner would approach the civil court for necessary directions. If any direction is passed, police will act by adhering to the provisions of law.

With the aforesaid observations WPA 22615 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
