The alleged contemnor appeared before the Joint Registrar cum Deputy Registrar (Writ), Appellate Side on the day the direction for personal appearance had been passed.

Under such circumstances, this court records compliance of the Rule.

Documents have been produced before this court which indicate that a decision was taken by the gram panchayat that the private parties had not taken any sanction and/or permission for construction. That the matter has now been sent to the concerned SubDivisional Officer for necessary steps under Section 23(5) of the West Bengal Panchayat Act, 1973.

Accordingly, the contempt application is disposed of and the contempt proceedings are dropped. The Rule is discharged.

Parties are directed to act on the basis of the server copy of this order.
