It is submitted that a civil suit between the parties is presently pending.

In my view, the possession of the petitioners over the premises in question is not in dispute. Therefore, the petitioners cannot be denied a water connection merely on the ground that a civil suit between the parties is pending.

Accordingly, the Pradhan, Olipur-Kashipur Gram Panchayat, respondent no. 3, is directed to consider the representation of the petitioners, appearing at page 27 of the writ petition, in accordance with law and to provide a water

connection to the petitioners, subject to payment of the requisite fees, within a period of one month from the date of communication of this order.

It is clarified that, while effecting the said connection, the possession and rights of the other cosharers shall not be disturbed. The water connection shall have no bearing on the pending civil suit. Accordingly, WPA 23184 of 2024 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
