1. Affidavit-of-service filed in Court today is taken on record.

2. The petitioners have filed the present writ application praying for recalling of the notice dated 13th August, 2024 issued by the Sub-Divisional Officer, Ghatal, Paschim Medinipur, being the respondent no. 6, directing the petitioners to appear before the Sub-Divisional Officer.

3. Learned counsel appearing for the State has submitted a report and submits that the Block Development Officer, Chandrakona-I, Development Block enquired into the matter and sent the enquiry report to the office of the Sub-Divisional Officer on 2nd August, 2023.

4. In the report of the Block Development Officer, it is categorically mentioned that the petitioners do not belong to SC-Rajwar sub-caste.

5. In the report it is further mentioned that the enquiry report was also communicated with the

Project Officer-Cum-District Welfare Officer, BCW, Paschim Medinipur on 18th August , 2023.

6. On receipt of the report, the notices have been issued to the petitioners but the petitioners have not appeared before the Sub-Divisional Officer for taking appropriate decision.

7. Considering the above circumstances, this Court finds that no purpose would be served in keeping the matter pending.

8. Accordingly, the present writ petition is disposed of by directing the Sub-Divisional Officer to conclude the proceeding within a period of six weeks from the date of receipt of this order.

9. If the petitioners will appear before the SubDivisional Officer on receipt of the notice, the SubDivisional Officer shall supply the copy of the report submitted by the Block Development Officer and the petitioners are at liberty to take exception to the report and after hearing of the parties, the Sub-Divisional Officer shall pass a reasoned and speaking order within a period of six weeks.

10. It is made clear that if the petitioners fail to appear before the Sub-Divisional Officer on receipt of the notice, the Sub-Divisional Officer free to take appropriate decision in absence of the petitioners.

11. Accordingly, WPA No. 24049 of 2024 is disposed of.

12. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, with all necessary formalities.
