1. Learned counsel for the appellant submits that subsequent to the filing of the appeal, an application under Sections 5 and 8 of the Arbitration and Conciliation Act, 1996 was filed in the trial Court, which was allowed and the suit has been relegated to arbitration.

2. Accordingly, CAN 1 of 2023, which is an application for condonation of delay in filing the appeal, is dismissed as infructuous.

3. Consequentially, FMAT No. 425 of 2023 and the connected application for injunction, being CAN 2 of 2023 are dismissed as well.

4. There will be no order as to costs.
