Pahari ........for the petitioner Dr. Sutanu Kumar Patra Ms. Supriya Dubey .....for the WBCSSC Mr. Supriyo Chattopadhyay Ms. Sayantanee Bhattacharjee .........for the State Petitioner participated in 1st State Level Selection Test, 2016 (Upper Primary) but was not adjudged as an eligible candidate since petitioner did not have teacher training qualification at the time of making application to participate in the aforesaid selection process. It is submitted on behalf of the parties that last date for acquiring training qualification was 24th October, 2016 but petitioner admittedly obtained training qualification in the year 2019. Another limb of submission made on behalf of the petitioner is with regard to creation of vacancies after initiation of selection process that is 1st SLST 2016 (Upper Primary), till 2024.

According to the petitioner, if in the category of the petitioner new vacancies are created petitioner should be considered eligible to be offered one of such vacancies taking note of the fact that petitioner acquired training qualification in 2019.

Having considered the submissions made on behalf of the petitioner, it appears that indisputably petitioner did not have training qualification within the cut-off date that is 24th October, 2016 and petitioner made application to participate in the aforesaid selection process as an untrained candidate.

Subsequently petitioner obtained training qualification in the year 2019, as submitted by learned advocate representing the petitioner. However, acquiring training qualification in the year 2019 does not confer right upon the petitioner to be considered for one of the vacancies relating to 1st SLST, 2016 (Upper Primary). Creation of posts in the category of the petitioner after initiation of selection process that is 1st SLST 2016 (Upper Primary) till 2024 ought not to be taken into consideration while appraising the candidature of the petitioner in connection with his participation in 1st SLST 2016 (Upper Primary).

In view of aforesaid discussion, no relief can be granted to the petitioner and the writ petition stands dismissed.

There shall be, however, no order as to costs.

However, this order shall not preclude the petitioner to make application in future for participation when similar selection process would be initiated by West Bengal Central School Service Commission, if petitioner is otherwise eligible.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
