Challenge in the present petition is to an order passed by the West Bengal Administrative Tribunal (for short 'the Tribunal') in O.A. No. 534 of 2016 whereby the application filed by the petitioner seeking compassionate appointment was dismissed. Impugned order passed by the Tribunal shows that the application was rejected inter-alia on two grounds. Firstly, the petitioner had claimed compassionate appointment after fifteen years of the death of his father and secondly, the widow of the deceased employee was also a government employee.

The aforesaid reasons are sufficient to non-suit the petitioner as compassionate appointment is provided to the dependent of the Government employee to take care of immediate financial distress on account of death of the earning member of the family. Thus, no case was made out for compassionate appointment for the son of the deceased employee as the widow of the deceased employee was already in Government service.

The writ petition is accordingly dismissed.
