1. Affidavit of service be kept with the record.

2. Heard the parties through their respective learned Counsels.

3. None appear on behalf of the respondent.

Despite being served through speed post, the envelope is returned undelivered with the postal remark 'Refused and Returned to Sender'.

4. In the instant case, the holder of PStP No.103/1994-95 has been plying the attached vehicle bearing no.WB41E/5214 on the route of Nabadwip to Kalna Ghat via Samudragarh, Dhatrigram etc. The permit was granted by the original Transport Authority Purba Burdwan which remained valid till 15.01.2030.

5. The petitioner further submits that said permit originally stood in the name of

Shibratan Chowdhury from whom it had been transferred in the name of the petitioner as per resolution of the RTA Board dated 16.09.2023.

After hearing the rival contention of the parties and perusing the material available on record I am considered view that the respondent No.2 is directed to consider the representation dated 25.08.2025 being annexed P3 at page 16 of the writ petition within a period of 60 days and pass a reasoned order in accordance with law upon affording opportunity of hearing to the interest parties.

7. Since the private respondent is not represented today, notice of hearing shall also be given by the respondent NO.2 to private respondent being No.6 intimating the date of hearing.

The said decision shall be communicated accordingly within a period of one week thereafter.

8. With the above observation and direction, this writ petition, WPA 22872 of 2025 stands disposed of without any order as to costs.

9. Photostat certified copy of this order, if applied for, be furnished expeditiously.
