Arif Hossain ....for the State The application for anticipatory bail is taken up for consideration subsequent to the order dated October 16, 2023. By such order dated October 16, 2023, the petitioner was enlarged on an interim anticipatory bail by the Coordinate Bench It is submitted at the bar that, the order granting interim anticipatory bail was passed just prior to the vacation without considering the materials in the case diary.

We considered the materials in the case diary. It appears from the materials in the case diary that the petitioner was engaged in collecting money from the members of the public on the promise of refunding the same with interest.

Apparently, the petitioner was engaged in conducting a chit fund business.

Complicity of the petitioner and the nature and extent of his business requires rigorous investigation. Custodial interrogation of the petitioner is felt in order to unearth the nature and extent of the business of the petitioner and involvement of the petitioner therein apart from any other persons that may be involved.

It is in public interest that such kind of businesses and conduct are investigated thoroughly.

In such circumstances, we are unable to extend the interim anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 4204 of 2023 is dismissed.
