In the instant revision the petitioner has prayed for a direction upon the Special Court, N.D.P.S. Act, Barasat, North 24-Parganas to dispose of Basirhat Police Station Case No. 187 of 2019 dated 1st March, 2019 under Section 21(c) of the N.D.P.S. Act, corresponding to N. Case No.52 of 2019. Mr. Prasun Kumar Dutta, Learned Additional Public Prosecutor, High Court Calcutta along with Mr. Subrata Kumar Roy, Learned Advocate is present in Court. The Learned Advocate for the petitioner is requested to serve a copy of the instant revision to Mr. Dutta.
Since the petitioner is in custody for about one year and ten months and trial of this case has not been commenced as yet, the Learned Trial Judge is directed to commence trial of
the case by recording evidence of the witnesses in N. Case No. 52 of 2019 on the next date fixed and positively conclude the trial within six months from the date of examination of the witnesses. The instant revision is, thus, disposed of. Appointment of Mr. Dutta and Mr. Roy on behalf of the State of West Bengal be regularized.
