1. The learned counsel for the petitioner submits that he is innocent and nothing has been recovered from the petitioner. It is further submitted that two co-accused persons have been granted bail by the jurisdictional court.

2. The learned counsel for the State in opposing the prayer has submitted that he stands on the same footing as the coaccused was recently granted bail and he is directly involved in the racket of smuggling of mobile phones.

3. Considering the materials available in the case diary and prima facie, it appears that he is a part of the racket of smuggling, we are not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
