The prime grievance of the petitioner is that although he had filed an application under Section 156(3) of the Code and the learned Magistrate directed the police to conduct a preliminary enquiry, no enquiry report was filed in time.

From the report filed by the State, it appears that several times notices were given, but the petitioner did not cooperate with the preliminary enquiry. Finally, a report was submitted on 12.10.2022. The learned ACJM, Ghantal, Paschim Medinipur was pleased to dispose of the matter by dropping the proceeding after perusing the report.

Inspite of this order passed in October, 2022, the petitioner went on to move the petition and made submissions about the inaction by the police before this Court on 05.12.2022.

Learned counsel appearing on behalf of the petitioner submits that this was a result of misunderstanding and miscommunication with the client.

In view of the above, the writ petition is dismissed.

However, there shall be no order as to costs. Urgent Photostat certified copies of this order may be delivered to the learned advocates for the parties, if applied for, upon compliance of all formalities.
