Heard learned counsels for the parties.

The petitioner is aggrieved by the fact that despite an order of interim injunction granted by the learned Trial Court in a civil suit pending before the learned Trial Court between the petitioner and the private respondent, the private respondent is continuing to disturb his peaceful possession in violation of the interim order of injunction. The petitioner seeks liberty to take necessary steps before the appropriate Court for redressal of his grievance. Learned counsel for the State submits that pursuant to the complaint filed by the petitioner before the police authority prosecution has been submitted against the private respondent under Section 126/135 (3) of the BNSS. The police is maintaining peace and tranquility in the area.

In view of the above, nothing further remains to be adjudicated in the writ petition and the same is accordingly disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
