Mr. Dinesh Pani Mr. Rabindranath Pradhan Ms. Sulagna Sen ....for the petitioners Mr. Tapan Kumar Mukherjee, AGP Ms. Tuli Sinha ....for the State Affidavit of service filed in Court today is taken on record.

The petitioners allege that the property of the petitioners within Mouza-Anantapur, J.L. NO.108 in the District of Purba Medinipur has been utilised without initiating any proceeding for requisition or acquisition. The learned advocate appearing for the petitioners submits that no compensation has been paid to the petitioners till date in spite of the fact that the land of the petitioners has been utilised for a public purpose. Mr. Mukherjee, learned Additional Government raises an objection as to the maintainability of this writ petition on the ground of unexplained delay and laches. He submits that the lands in question were acquired pursuant to an acquisition proceeding initiated sometimes in the year 1976-77. He submits that the award was declared. The predecessor-in-interest of the petitioners namely, Sudhir Mandal and Shyamapada Mandal as well as one Manmatha Mandal were the awardees and their

names appeared under award serial Nos.27, 28 and 26 respectively.

Thus, it appears that the petitioners have approached this Court by deliberately suppressing the material facts.

Accordingly, WPA 22889 of 2025 stands dismissed. There will be no order as to costs.
