Mr. Bhaskar Sengupta, ....for the petitioner Mr. Soumen Bhattacharjee, Mr. Shredhya Ghosh, ...for the respondents The learned Advocate appearing on behalf of the petitioner submitted that the petitioner had preferred an appeal against the assessment order dated 29th December 2018, passed under Sections 143(3) and 147 of the Income Tax Act, 1961 in respect of the assessment year 2011-12, before the Commissioner of Income Tax (Appeals). It is further submitted on behalf of the petitioner that the said appeal has not been disposed of to date.
The learned Advocate appearing for the Revenue does not dispute that the appeal is pending before the Commissioner of Income Tax (Appeals). In view of the foregoing, this Court does not find any justification for keeping the present writ petition pending.
Accordingly, the writ petition is disposed of, with a direction to the Commissioner of Income Tax (Appeals) to dispose of the appeal within six weeks
from the date of communication of this order, in accordance with law.
Accordingly, WPA 23255 of 2024 is disposed of.
There shall be no order as to costs.
Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
