Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner applied for recruitment to the post of Librarian in Sponsored Pubic Library having the Status of Rural Library in Bankura District under the Local Library Authority, Bankura. The petitioner had applied as an unreserved candidate. According to the relevant notification of 2011, if the unreserved exempted category posts are not filled up, then there is a process by which the same can be converted into non-exempted category seats. In the instant case, the UR-EC seats were not filled up and therefore, they

need to be converted into non-exempted seats. The petitioner as a qualified candidate should also be recruited for the said post. In fact, he is a waitlisted candidate.

Learned counsel for the State relies on the report and submits that the State authorities have already applied for conversion of exempted category post to non-exempted ones. Learned counsel appearing on behalf of the respondent no.3 submits that 21 unreserved category seats have already filled up. The rest 10 seats would be converted into from exempted category to non-exempted category seats as they have not been filled up till date. Necessary steps are being taken. However, appointment of the petitioner to the post will be depend on his eligibility and on relevant rules and notifications.

It appears that the respondents have already taken steps to have the unreserved exempted category seats to be converted to non-exempted category seats.

Therefore, no further order need be passed in this regard.

However, it is expected that the respondent authorities shall expedite the process and consider the petitioner's case for recruitment to the said post in accordance with law and merit at the earliest.

With these observations, the writ petition is disposed of.

However, the merits of the case have not been gone into.
