In spite of service none appears for the respondents except the State-respondents.
The petitioners claim to be the owner of several plots within Mouza - Sahebkha Keranibar in the district of Purba Medinipur. The petitioners allege that the Panchayat authorities have encroached upon the PWD road lying and situated adjacent to the aforesaid plot of the petitioners. The petitioners submitted a representation dated September 8, 2025 before various authorities including the Assistant Engineer, PWD, Contai Highway Sub-Division.
Learned advocate appearing for the petitioners submits that in spite of receipt of such representation
no steps have been taken by the respondent authorities to remove illegal encroachment upon the PWD road.
Mr. Bandyopadhyay, learned advocate, appears for the State-respondents. He submits that steps in accordance with law shall be taken if an encroachment is found upon the PWD road.
In the light of the submissions made by the learned advocates for the respective parties, this writ petition stands disposed of by directing the Assistant Engineer, Public Works Department, Contai, Purba Medinipur, being the 8th respondent herein, to consider the representation of the petitioners dated September 8, 2025 and after making necessary enquiries and demarcation if it is found that there has been an encroachment upon the PWD road, necessary steps in accordance with Section 10 of the Highways Act shall be initiated and the entire exercise shall be completed by such respondent as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order along with a copy of the representation dated September 8, 2025.
