Mr. Indranil Halder ... for the petitioner Mr. Debanjan Mukherjee ...for CESC Limited The petitioner seeks reconnection of an electricity connection standing in the name of her son, Deep Sadhukhan.

It appears that a provisional assessment amounting to Rs. 1,014/- has been made against the petitioner on the ground of unauthorized extension of electricity. The petitioner, however, submits that she is willing to pay the provisionally assessed amount in full.

Learned counsel appearing for the Calcutta Electric Supply Corporation Limited (CESC) submits that there was another electricity connection in the name of the petitioner's husband, which was also disconnected on the allegation of electricity theft. It is further submitted that a final order of assessment was issued in that case, requiring the petitioner's husband to pay Rs. 2,81,114/- (Rupees two lakh eighty-one thousand one hundred and fourteen). According to the CESC, there exists a clear nexus between the petitioner and her husband, and therefore, the electricity connection should not be

restored unless the entire outstanding dues in respect of the said premises are cleared by the petitioner. Learned counsel for the petitioner, however, denies the allegation of such nexus. It is submitted that the petitioner's husband has already deposited 50% of the finally assessed amount.

This Court is of the view that it is not necessary to examine the question of nexus between the petitioner and her husband in the present writ petition. In light of the fact that 50% of the finally assessed amount has already been deposited by the petitioner's husband, I am not inclined to delve further into that issue.

Accordingly, the CESC Limited is directed to restore the electricity connection standing in the name of the petitioner's son, subject to payment of the provisionally assessed amount, along with reconnection charges and any other applicable dues. Upon deposit of the said amounts, the electricity connection shall be restored within 48 hours from the date of such deposit.

Accordingly, WPA 22583 of 2025 is disposed of.
