Mr. Subir Ganguly ..for the State The dispute in this case arises out of a dispute between erstwhile management of a Jute Mill namely, M/s Swarnandhra Jute Mills Pvt. Ltd. and its present management. Following the complaint lodged by the erstwhile Director of the said company/Opposite Party No.2, Phoolbagan Police Station Case No.184 dated 31.12.2018 under Sections 384/389/420/464/467/471/506 of the Indian Penal Code was registered against the petitioners. Upon investigation a charge sheet No.101 dated 20.12.2024 has been filed under Sections 384/389/420/467/464/471/506 of the Indian Penal Code against the petitioners.
Challenging the aforesaid proceedings, the present application has been filed by the petitioners. The petitioner has filed the present application seeking quashing of the aforesaid proceedings. It appears that the disputes between the parties have since been amicably resolved. In this regard, the parties have jointly filed a petition of compromise before this Court, being CRAN 1 of 2026.
Upon consideration of the materials on record, this Court is of the view that the dispute between the parties is essentially commercial in nature and that a valid compromise has already been arrived at between them. In such circumstances, the continuation of the criminal proceedings would amount to an abuse of the process of law.
Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to quash the present proceedings in the interest of justice.
Accordingly, G.R. Case No. 08 of 2019 under Sections 384/389/420/464/467/471/506 of the Indian Penal Code arising out of Phoolbagan Police Station Case No. 184 dated 31.12.2018 which has culminated into Charge sheet No.101 dated 20.12.2024 stands quashed in terms of the compromise recorded in CRAN 1 of 2026.
Consequently, CRR 4306 of 2025 along with CRAN 1 of 2026 stands disposed of.
