19.02.2024 Item No.2 Ct. No.17 S.A.

WPA 22805 of 2022 Nitya Kumar Saha -vs- Employees' State Insurance Corporation & Ors. Mr. Joy Chakraborty Mr. Ranjit Malakar ...for the petitioner Mr. Mihir Kundu ...for E.S.I. Corporation The petitioner never wanted to proceed with this matter which appears from several orders and ultimately one notice was issued pursuant to an order of this court dated 02.02.2024.

Learned advocate Mr. Ranjit Malakar said that the only point is that E.S.I. has issued one notice to only one partner and not to the other.

I hold that such notice is sufficient for the other partner also. The notice is in the name of M/s. Desha International i.e. the partnership firm as Annexure P-5 vide page 22.

Therefore, I do not find any merit in this writ application which is kept pending from 30.11.2022. The writ application is dismissed with a cost of Rs.5000/- (rupees five thousand) to be paid to the High Court Legal Services Committee and the E.S.I. is directed to take required steps to realise the amount due, if any, by two months from date.
