Exception filed in Court today is taken on record. 2.

The petitioner is aggrieved with the order of blacklisting for a period of three years with effect from 9th January, 2023 and further forfeiture of the earnest money of Rs. 9,000/- (rupees nine thousand only).

The sheet anchor of the petitioner's submission is that the order of blacklisting is passed without hearing the petitioner. Principle of natural justice is alleged to be violated.

The petitioner has disclosed in the writ petition that the petitioner remained absent in his house because of treatment of his wife at Kolkata. The petitioner thereafter went to the postal authority to collect the communication addressed to him but the same was not handed over to him with the explanation that the postal article was returned to the sender.

Prayer has been made to set aside the impugned order.

The Sub Divisional Officer, Bongaon has filed a report in the form of affidavit disclosing all documents and postal receipts to show that repeated efforts to serve the petitioner failed. One of the communications was, however, received by his wife.

On a perusal of the documents, it appears that out of the three years of blacklisting, more than two and half years have expired. The period of blacklisting is going to end in early January, 2026.

At such late stage, the Court is not inclined to interfere in the matter.

After the blacklisting period is over, the parties will take steps in the matter in accordance with law.

10. The writ petition stands disposed of.

11. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
