Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years six months and PW1 is still being examined till date. Learned advocate submits that the NCB intends to examine 6 witnesses in support of its case and there is no possibility of the trial being concluded in near future, as such the petitioner may be released on bail on any stringent conditions as similarly placed accused persons have already been granted bail.
Learned advocate for the NCB opposes the prayer for bail and submits that the petitioner is the owner of the house and the earlier bail order itself reflects the complicity of the present petitioner.
Be that as it may, from the materials available in the case records in possession of the NCB, it reflects that prima
facie, there are materials which allegedly substantiate the claim of NCB.
As a matter of last chance, opportunity is granted to the Narcotics Control Bureau to conclude the trial within next six months preferably by 11th of June, 2026. In case the evidence of the prosecution witnesses are not concluded, petitioner would be released by the trial Court on such terms and conditions as the learned trial Court deems fit and proper. No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of the resolution of the local bar.
It is further directed that, if there is any violation on the part of the accused, however, the aforesaid directions will not apply.
With the aforesaid observations CRM (NDPS) 1199 of 2025 is dismissed.
Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
