The present revisional application has been preferred challenging the order dated 02.08.2023 passed in Criminal Revision No.22 of 2023 by the learned Additional District and Sessions Judge, Ranaghat, Nadia wherein the learned Sessions Judge was pleased to refuse the application for stay but kept the revisional application pending by calling the lower court records and transferring the case to the learned Additional District and Sessions Judge, FTC, Ranaghat for disposal.

Having considered that the revisional application is still pending and the petitioner is aggrieved by the interim order, I am of the opinion that the jurisdiction of this Court cannot be invoked for the purposes of interfering with refusal of interim order during pendency of the main revisional application. The revisional court is directed to dispose of the revisional application and arrive at its finding at the earliest preferably within six months from the date of communication of this order.

With the aforesaid observations, CRR 3600 of 2023 is

disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
