Petitioner Mr. Moyukh Mukherjee Mr. Abhijit Singh ...for the petitioner The petitioner prays for expeditious disposal of the execution case being C. Execution Case No. 36 of 2022 which was filed before the learned ACJM, Bidhannagar in relation to a proceeding under the provisions of PWDV Act.

According to the learned advocate for the petitioner, till date not a farthing has been paid to the present petitioner who is suffering from financial stringency. Learned advocate submits that the next date is fixed on 2nd March, 2024. According to the learned advocate, in the execution case on the prayer of adjournment of the husband/OP, regularly time has been granted.

Be that as it may, I direct that the learned trial court would ensure that the petitioner should get at least 25% of the arrear amount on the next date. The learned trial court is also directed to fix a subsequent date within a month for 50 % of the amount which is left.

All efforts be taken to exhaust the whole arrears to be recovered by 20th May, 2024.

In case the husband/OP adopts any dilatory tactics, the learned ACJM, Bidhannagar would direct the Passport Authorities to inform the Candian Embassy for compelling the husband /OP to return to India.

With the aforesaid observations, CRR 3603 of 2023 is disposed of.
