This writ petition has been filed being aggrieved by the order of detention of goods in question of the petitioner, which according to the petitioner has not been released in spite of making application dated 8th September, 2022 before the WBGST Authority concerned.
Mr. Siddiqui, learned Additional Government Pleader submits that the aforesaid application for release of the detained goods in question is not in proper form.
I am of the view that even if the respondent authority has found the application not in proper form, they should have informed the petitioner the formalities and specific form under which the
petitioner can claim for release of the goods in question which they have failed to do.
Considering the submissions of the parties, this writ petition being WPA 22812 of 2022 is disposed of by directing the respondent WBGST Authority concerned to consider and dispose of the above mentioned representation in accordance with law and by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioner or his authorized representative within a period of two weeks from the date of communication of this order. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all necessary formalities.
