The petitioner's prayer seeking higher scale of pay on account of enhancement of his educational qualification is pending consideration before the District Inspector of Schools (SE), Howrah.

The petitioner relies on the judgment delivered by the Hon'ble Special Bench of this Court on 7th February, 2024 in the matter of Utpal Kanti Karan -Vs State of West Bengal & Ors. reported in 2024 SCC Online 1274.

Without entering into the merit of the claim of the petitioner, the instant writ petition stands disposed of by directing the District Inspector of Schools (SE), Howrah to consider and dispose of

the prayer of the petitioner strictly in accordance with law and in line with the judgment referred to hereinabove after giving reasonable opportunity of hearing to the petitioner and all other necessary parties at the earliest but positively within a period of twelve weeks from the date of communication of this order.

The petitioner shall be permitted to rely upon all documents including the orders/judgments passed by the Court in support of his claim at the time of hearing.

A reasoned order shall be passed and communicated to the petitioner.

If the claim of the petitioner is allowed, then necessary consequential steps shall be taken for releasing the enhanced amount by the authority without any further delay.

The writ petition stands disposed of.

8.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
