16.09.2021 Sl. No.55 Court No.34 BM CRR 3022 of 2012 HARI MOHAN SINHA@SINHGA ROY & ORS Vs.

STATE OF WEST BENGAL Mr. Arijit Ganguly Mr. Sanjib Kumar Dan ... for the State The revisional application was preferred against the order dated 17.05.2012 wherein the learned Sessions court was pleased to refuse the prayer for deferring examination in chief of PW-1 till the examination in chief of the witnesses Bikash Roy and Swapan Roy are over.

The records of this revisional application reflect that the same is yet to be admitted. As none appeared on behalf of the State, assistance of Mr. Arijit Ganguly, learned advocate, was sought for, as such his appointment may be regularised by the concerned authorities. Having regard to the fact that the Sessions case related to the year 2007 and the Police Station case related to the year 2003, I am of the view that no interference is called for as the chronology of the witnesses to be examined are the exclusive domain of the trial court.

Accordingly, CRR 3022 of 2012 is disposed of. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All the parties are directed to act on the server copy to be obtained from the official Website of the Hon'ble High Court at Calcutta.
