In view of Survey Park Police Station Case No. 13 dated 13.01.2025 registered for investigation under Sections 467/471/420 of the Indian Penal Code pursuant to the Special Investigation Team (SIT) constituted by the Commissioner of Police, Kolkata. It is directed that the SIT so constituted by the Commissioner of Police, Kolkata for the purposes of similar nature of cases would continue till further orders of the Commissioner of Police, Kolkata. If any member of the SIT is changed, in that case permission be obtained from the Commissioner of Police, Kolkata so that an efficient officer be substituted in place of any transferee officer which the administration thinks fit and proper. Without permission from the Commissioner of Police, Kolkata, no officer should be relieved of his responsibilities from the SIT.
Since the case has been registered and the investigation of the case is in progress, I direct that the investigating agency will take the investigation
to its logical conclusion by exhausting all its efforts preferably within a reasonable period of time. The petitioner complains that he is subjected to certain coercions by the police authorities. Since a case has been registered and a jurisdictional court is already in seisin of the matter, the petitioner is granted liberty to take up the issues before the jurisdictional court.
With the aforesaid observations, the writ petition being WPA 23227 of 2024 is disposed of. Case diary be returned to the learned advocate appearing for the State.
There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
