Dipankar Chatterjee (Through Video Conference) The appellant is not represented even in the second call nor any accommodation is prayed for on behalf of the appellant. The appellant was also not represented on the earlier occasion. Considering the report of the Stamp Reporter and having regard to the fact that no application for condonation of delay has been filed, the appeal is time barred and accordingly dismissed as time barred. Moreover, we feel that by passage of time, this appeal has also now become infructuous.
