CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 3035 of 2012 In the matter of : Pulin Behari Maity. ....petitioner. In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred against the judgement and order dated 31st July, 2012 passed in Criminal Revision No. 39 of 2011 which was dismissed and was preferred against the order dated 12-05-2011 passed by the learned Judicial Magistrate, 2nd Court, Contai in connection with Misc. Case No. 184 of 2009 under Section 125 of the Code of Criminal Procedure.

The record of this revisional application reflects that the learned Magistrate directed to pay a sum of Rs. 2000/- towards maintenance allowance and a co-ordinate Bench of this court by an order dated 27th September, 2012 directed the petitioner to continue payment of Rs.,2000/- per month as ordered by the learned trial court.

Having regard to the contentions so advanced by the petitioner, I am of the view that the interim order passed must be made absolute.

Accordingly, no interference is called for by this court. As such, the present revisional application being CRR 3035 of 2012 is dismissed.

The interim order dated 27th September, 2012 directing the petitioner to continue payment of Rs.2000/- per month is made absolute.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
