Nilkantha Khuntiya v. State Of West Bengal And ORS.
W.P.A. 22497 of 2023 Nilkantha Khuntiya.
VS The State of West Bengal & Ors.
Mr. Debkumar Maity.
...for the petitioner.
Mr. Salil Kumr Maity, Ms. Pinki Saha.
... for respondent nos. 7 to 9.
Mr. Ashim Kr. Ganguly, Ld. Sr. Adv, Mr. Tarak Karan.
...for State.
Petitioner is aggrieved by the representation dated 19.05.2025 Court No. 35 Item No.30 Rakib 29.05.2023 not having been considered by the Officer-inCharge, Chandipur Police Station. State has submitted a report. Report reflects that Chandipur Police Station case no. 330/2023 was initiated under Sections 447/323/379/506/34 of the Indian Penal Code. Subsequently, the investigation of the case has been completed and charge-sheet was submitted on September, 2023.
Having considered that steps were taken by the police authorities at the relevant point of time and the report also reflects that number of proceedings have been drawn under Section 107 of the Cr.P.C. against the private respondents, I am of the view that the police authorities adhered to the informations which were furnished to them. Inspite of the same, if the petitioner is faced with further inconveniences, petitioner would file his representation to the police authorities, police
authorities will act in accordance with law on receipt of such information.
Learned advocate for the private respondent nos. 7 to 9 is present and denies and disputes the accusations so made.
Having considered that police authorities have taken steps, as such further pendency of the writ petition is unwarranted.
Accordingly, WPA 22497 of 2023 is disposed of. Report so submitted by the State be kept with the record.
