Nayan Mandal versus The State of West Bengal & Ors.

Petitioner is aggrieved by the inaction of the police authorities as the representation dated 22.07.2025 addressed to the Superintendent of Police, Malda has not been addressed in proper perspective.

On the other hand, learned advocate appearing for the State submits that similar representation was made in WPA 17918 of 2025 wherein this Court by an order dated 12.08.2025 directed the Superintendent of Police, Malda to conduct an enquiry through an authorised officer for assessing whether there is threat perception which has been complained of is genuine and in case the same is found to be genuine to take steps in accordance with law.

Learned advocate appearing for the petitioner submits that presently during the pendency of the writ petition, petitioner has been subjected to assault and is at present hospitalised. To that effect, no representation is available with the police authorities. Consequently, I direct that in case any fresh complaint is submitted with the police

authorities, they would take steps in case cognizable offence has been made out by way of registration of a case and take the same to its logical conclusion.

With the aforesaid observations, the writ petition being WPA 22829 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
