Learned counsel for the respondent authorities hands over a written communication dated January 5, 2024 issued by the Executive Engineer-I, Burdwan Division, PWD, that is, respondent no.5 to the learned Advocate for the State indicating that an amount to the tune of Rs.46,79,697/- has been received by the respondent no.5 and the payment of the executed portion of the work is "under process and utilization of the same will be intimated shortly".

In view of the said internal communication, there cannot be any doubt that there is no further impediment to release the amount in favour of the petitioner immediately.

Accordingly, WPA 22847 of 2022 is disposed of directing the respondent no.5 to disburse the amount to the tune of Rs.46,79,697/- to the petitioner, by whatever mode as agreed between the parties and/or

recognized in due process of law, positively within January 15, 2024.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
