With CRM (DB) 3143 of 2024 CRAN 1 of 2026 In Re: An Application for relaxation of condition of bail under Section 439(1)(b) of the Code of Criminal Procedure corresponding to Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023. And In the matter of : Gourav Jain Mr. Apalak Basu Ms. Sanghamitra Mirdha .....for the Petitioner.

In Re: CRAN 1 of 2026 in CRM (DB) 3143 of 2024 Learned advocate appearing for the petitioner submits that the condition which was imposed to remain within the jurisdiction of Bidhannagar Police Commissionerate is creating hardship. The bail was granted on 21.04.2025 and for a period of almost one year the petitioner has been complying with the conditions. Having regard to the period which has passed in the meantime, I am of the view that the condition be modified to the extent that the petitioner shall remain within the jurisdiction of District of North 24 Parganas and Hooghly.

If the petitioner intends to go out of the two jurisdictions, in that case petitioner will seek permission of the learned trial Court and necessary directions under such circumstances would be passed by the learned trial Court.

With the aforesaid observations CRAN 1 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
