On prayer of the petitioner, liberty is granted to implead the Secretary, State Transport Authority, West Bengal as respondent no.5 in the writ petition. The cause title of the writ petition be amended accordingly.
The petitioner seeks a direction upon the 5th respondent to consider the representation submitted by him before the authority on 25th July, 2023 for cancellation of permit of the private respondent. The representation is yet to be considered.
Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the 5th respondent to consider and dispose of the representation submitted by the petitioner dated 25th July, 2023 within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing
to all concerned including the petitioner and the private respondent, in accordance with law.
The decision taken by the authority shall be communicated to the parties within a week thereof. With the above observations and directions the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
