Mr. Sk. Toslim Ali ...For the petitioner. The plaintiff in a suit for declaration is the petitioner of instant application under Article 227 of the Constitution of India. The said suit being Title Suit No. 71 of 2024 pending before the Court of the learned Civil Judge, (Junior Division) at Amta, District - Howrah.

The prayer of the petitioner for an ad interim order of injunction was refused by the learned Trial Judge. Aggrieved thereby the petitioner has preferred the connected Miscellaneous Appeal No. 08 of 2024. The appeal Court below by the order impugned being Order No. 04, dated August 06, 2024 has refused to pass an ad interim order of injunction.

In view of the limited scope of the appeal, the order impugned does not call for any interference. C.O. 3317 of 2024 therefore is dismissed without any order as to costs.
