Mr. Souradipta Banerjee Mr. Badal Singh Ms. Shamrin ....for the petitioner Mr. Banerjee, learned advocate appearing for the petitioner submits that though the order dated June 27, 2025 passed by the learned Judge, 8th Bench, City Civil Court at Calcutta in Title Suit No.2380 of 2022 is under challenge in this civil revision application, has been instructed to pray for expeditious hearing of the suit. Mr. Banerjee submits that the instant suit was filed sometime in the year 2016 and after the same was transferred to the City Civil Court at Calcutta it was renumbered as Title Suit No.2380 of 2022.

Mr. Banerjee, learned advocate appearing for the petitioner submits that a date has been fixed on December 16, 2025 for hearing on the point of acceptance of the written statement filed by the defendant No.3. He submits that such application is otherwise ready for hearing and the written objection thereto has already been filed. Mr. Banerjee submits, on instruction, that instead of going to the technicality and in order to expedite the hearing of the suit the written statement filed by the

defendant No.3 on November 29, 2024 be accepted by this Court.

In the light of the submission made by Mr. Banerjee the written statement filed by the defendant No.3 on November 29, 2024 is accepted.

The learned trial judge is directed to proceed in accordance with law and if necessary by framing additional issues as a consequence of this order. In the light of the submission made by the learned advocate for the petitioner, CO 3551 of 2025 stands disposed of by requesting the learned Judge, 8th Bench, City Civil Court at Calcutta to make an endeavour to dispose of the Title Suit No.2380 of 2022 as expeditiously as possible but preferably within a period of six (6) months from the next date fixed without granting any unnecessary adjournments to either of the parties.

The time limit has been fixed by this Court taking note of the fact that the suit is pending from the year 2016.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
