By the present writ petition the petitioners seek direction upon the respondent authorities particularly respondent nos.2, 4 and 5 to provide financial benefit and to accord approval of appointments of petitioners to the post of teaching and non-teaching staff as they have been working on organizing basis since long period and to pay their salary in accordance with law. 2.

It is the precise contention of the petitioners that pursuant to order passed in appeal being FMA 2639 of 2015 applications were submitted on 11th August, 2017 as well as on 22nd February, 2024 seeking extension of period of provisional recognition, which is pending consideration.

Mr.

Nadeem Sulaiman, learned advocate for respondent no.4, Secretary, West Bengal Board of

Madrasah Education submits that already letter has been issued by the Secretary, West Bengal Board of Madrasah Education on 4th July, 2025 asking the Madrasah Authority to produce relevant documents relating to renewal of recognition. The Madrasah Authority has not yet produced the same. He informs the court that upon production of the relevant documents the aspect of further extension/renewal of recognition of the Madrasah will be considered by the West Bengal Board of Madrasah Education in accordance with law.

In view of such submissions, the writ petition is disposed of directing respondent no.4, Secretary, West Bengal Board of Madrasah Education to consider the renewal of the recognition of the concerned Madrasah within a period of three months from the date of communication of this order subject to production of requisite documents by the concerned Madrasah as per the check list in accordance with law.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.4, Secretary, West Bengal Board of Madrasah Education for necessary action.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 7.

Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of.

There shall be no order as to costs.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

11.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
