Mr. Singh, learned advocate appearing along with Mr. Sandeep Dey, learned advocate prays for leave to file the Vakalatnama in the department in course of this day. Such prayer is allowed.
A copy of the revisional application has been served upon Mr. Singh in Court today.
Mr. Chaturvedi, learned advocate appearing for the petitioners by drawing the attention of this Court to several orders, which have been made part of the revisional application submits that hearing of the suit is being delayed by the opposite parties herein. Mr. Singh, learned advocate representing the opposite party no.2 submits that several interlocutory
applications including an application under Order 7 Rule 11 of the Code of Civil Procedure is pending. He submits in view thereof, no direction for expeditious hearing of the suit, at this stage can be passed. Heard the learned advocates for the parties and perused the materials on record.
It appears from the order-sheet that an application under Order 7 Rule 11 of the Code of Civil Procedure, Order 6 Rule 17 of the Code of Civil Procedure as well as an application under Order 11 Rule 14 of the Code of Civil Procedure are pending.
Since the instant suit was filed sometimes in the year 2007 and the same is still pending, this Court is of the considered view that hearing of the interlocutory applications is to be expedited and after disposal of the interlocutory applications, the learned Trial Judge shall take up hearing of the instant suit and dispose of the same as expeditiously as possible. C.O. 3304 of 2023 is disposed of by requesting the learned Civil Judge (Junior Division), 3rd Additional Court at Alipore to take up hearing of the interlocutory applications on the next date fixed for hearing of the same and dispose of the same as expeditiously as possibly but preferably within a period of three months from the next date fixed for hearing of such applications.
After disposal of the interlocutory applications, the learned Trial Judge is requested to take up hearing of the Title suit No.8 of 2013 and dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties expeditiously upon usual formalities.
