Sri Anup Kumar Pal Mr. Suman Chakraborty ....for the petitioner This application under Article of the Constitution of India is at the instance of the wife and is directed against an order being No.47 dated May 7, 2025 passed by the learned Additional District Judge, 1st Court Arambagh, District-Hooghly in Miscellaneous Case No.15 of 2023 arising out of Matrimonial Suit No.46 of 2019. By the order impugned the application under Section 24 of the Hindu Marriage Act stood rejected. The learned advocate appearing for the petitioner submits that the income of the husband is Rs.70,000/- per month. He, therefore, submits that the husband should be directed to pay alimony to the wife. It is not in dispute that the husband made a registered deed of gift in favour of the wife in respect of 100 sq. ft. godown on May 30, 2017 to the wife/petitioner.
It is also not in dispute that the husband/opposite party provided the purchase money for purchase of a property in the name of the wife on December 13, 2013 when they were living together at that point of time.
a sum of Rs.70,000/- per month but could not substantiate such allegation by producing any material in support thereof.
The learned advocate appearing for the petitioner however did not dispute that the wife is a salaried person. From the reply given under the provisions of Right to Information Act, it is evident that the wife/petitioner is getting a salary of Rs. 24,120/- per month.
Since the petitioner has independent income of her own for her sustenance, the Court is of the considered view that the learned trial judge was right in rejecting the application under Section 24 of the Hindu Marriage Act. For such reason, this Court is not inclined to interfere with the order impugned.
Accordingly, CO 3550 of 2025 stands dismissed. There will be no order as to costs.
