18.11.2025 Serial no. 49 [G.S.D] CRM (M) 1773 of 2025 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Session Case No. 57 of 2024 (GR Case No. 2769 of 2023) arose out of Goalpokher PS Case No. 530 of 2023 dated 21.09.2023 under sections 302/212 & 120B of the IPC, 1860 read with Sections 25(i)(a), 27 & 35 of the Arms Act.

Rahul Ganguly ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was nowhere named and hardly any materials have surfaced in course of the evidence, inspite of the same, the petitioner is detained in custody for more than two years.

Learned advocate for the State has submitted a report which reflects that 21 witnesses out of the proposed 30 witnesses have been examined till date.

Learned advocate for the State has candidly submitted that so far as the locus of the present petitioner is concerned, he has not a threat to the witnesses who are proposed to be examined.

However, so far as the merits of the case is concerned, the same be decided after the evidence of the prosecution is over.

Having regard to the overall circumstances, further detention of the petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Md. Tamrej @ Tamrez shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Uttar Dinajpur.

If on bail, the petitioner shall make himself physically available before the learned trial court on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of Uttar Dinajpur without prior intimation to the learned trial court.

Accordingly, CRM(M) 1773 of 2025 is allowed.

Pending application(s), if any, is also disposed of. The Investigating Officer of the case is present in court today. His further appearance before this court in this matter is dispensed with.

Report so submitted be kept with the record.
