Mr. Bhattacharjee, SSC, submits that the said dispute can be referred to only if the application has been filed within the prescribed period of limitation. Learned advocate appearing for the petitioner submits that the notices under Section 12(2) of the Land Acquisition Act, 1894 are dated August 9, 2026 and August 25, respectively and the applications under Section 18 of the 1894 Act have been submitted on September 11, 2006. He submits that the application has been filed within the specified timeframe.

In the light of the submissions made by the learned advocates appearing for the respective parties this writ petition stands disposed of by directing the Collector, Purba Bardhaman, being the 2nd respondent, to consider the application filed by the petitioners under Section 18 of the 1894 Act and if the same are submitted within the prescribed period of limitation, the Collector shall take steps for referring the matter for the determination of the Court as expeditiously as possible but positively within a period of four weeks from the receipt of a server copy of this order along with the photocopy of the application filed under Section 18 of the 1894 Act.
