1. Contempt application is heard in presence of the learned advocates representing the applicants and the alleged contemnors. It is alleged on behalf of the applicants that order dated 9th March, 2017 passed by a coordinate bench on the connected writ petition till date is not complied with.
2. On the contrary, learned advocate representing alleged contemnors submits in reference to a letter dated 8th February, 2024 of the Sub-Divisional Officer, Ghatal, Pashim Medinipur that steps were taken to handover the possession of plot of land in question on 18th December, 2023 when no one remained present on behalf of the applicants for taking possessing of the said land as a result whereof
order dated 9th March, 2017 could not be complied with.
3. However, Mr.
Mondal, learned advocate representing the applicants submits that in terms of the order dated 9th March, 2017 land which is described in the schedule to conveyance deed needs to be handed over.
Relying upon page 41 of the contempt application it is further contended that as per schedule of the conveyance deed dated 31st May, 2000 land described as RS Plot No. 63 (southern portion) under P.S. Ghatal, MouzaKuspata, Gobindapur needs to be handed over to the applicants. It is alleged that alleged contemnors are trying to hand over a different piece of land which is not described in the schedule of the conveyance deed dated 31st May, 2000.
4. On behalf of alleged contemnors 4 (four) weeks time is prayed for in order to comply with the direction as contained in the order dated 9th March, 2017. In order to grant opportunity to the alleged contemnors to comply with the order dated 9th March, 2017 passed by the coordinate bench, hearing of this contempt application stands adjourned.
5. List the matter under the same heading in the monthly combined list of January, 2026.
6. On the next date alleged contemnors shall file affidavit of compliance.
7. Copy of the memo dated 8th February, 2024 issued by Sub-Divisional Officer, Ghatal, Paschim Medinipur is taken on record.
8. Leave is granted to the learned advocate for the applicants to amend the cause title of this contempt application and add present incumbents as additional alleged contemnors in course of this day.
