1. Contempt is alleged of this Court's order dated 25th August, 2022.

2. This Court had directed the respondents to process the petitioner's application in terms of the amended Rules of 2015. The petitioner was granted liberty to apply afresh only to modify the original choice of schools if vacancy opted for earlier have been filled up in the meantime. The petitioner did not so apply.

3. By an order dated 16th January, 2025, The West Bengal School Service Commission communicated the petitioner that since the petitioner had preferred only one school, namely, L.M.S.M. High School for transfer and he was second in rank of applicant as per the Utsashree portal, his request could not be considered. Since the petitioner is expected to know his rank in the order of candidate for transfer to a particular school and had not given any further option, the respondents cannot be held to have committed any contempt.

4. In that view of the matter, reserving liberty to the petitioner to apply afresh for transfer, CPAN 1627 of 2025 shall stand disposed of. Rule, if any, shall stand discharged.

5. The personal presence of the alleged contemnors is dispensed with.

6. There shall be no order as to costs.

7. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
