Mr. Rajendra Banerjee ....for the applicant / petitioner.
Mr. Madhusudan Sur, Mr. Pratick Bose ....for the State.
This is an application for relaxation of condition of anticipatory bail granted on 15th November, 2019, passed in CRM No.10460 of 2019.
Mr. Banerjee, learned advocate for the applicant/petitioner submits that due to financial constraints, the petitioner could not arrange the money to furnish the bail bond within the period as directed in the order dated 15th November, 2019 passed in CRM No. 10460 of 2019.
Mr. Sur, learned Additional Public Prosecutor for the State opposes the petitioner's prayer and submits that the petitioner has approached this Court belatedly.
It appears that the present application was filed before this Court on 23rd December, 2020 and it has appeared for the first time.
Upon hearing the learned advocates and considering the materials on record, we are satisfied with the explanation given by
the petitioner towards his failure to appear before the learned court below and to obtain regular bail within the time specified. Accordingly, the present application, being CRAN 1 of 2020 is disposed of directing that the petitioner shall appear before the learned court below and pray for regular bail within a period of fortnight from date.
