Ref: I.A. No CAN 1 of 2024 This is an application for restoration of the connected writ petition which was dismissed for default on June 05, 2023.
Perused the application, it appears that the petitioner was prevented by sufficient cause from appearing before the Court when the matter was called on for hearing, the order dated June 05, 2023 is, therefore, recalled. W.P.A. 22879 of 2022 is restored to its original file and number.
I.A. No. CAN 1 of 2023 is, thus, disposed of without any order as to costs.
Ref: W.P.A. 22879 of 2022 On the consent of the parties the writ petition is taken up for consideration.
The petitioner is an Assistant Teacher of Narajole Mahendra Academy High School (H.S.), District-Paschim Medinpur, she applied for general transfer through "Utsashree Portal" inter alia on the grounds that the distance between her residence and the school is more than 40 kilometres and that she has a minor child in the home. The grievance of the petitioner is that though the said Portal is under suspension but the West Bengal Central School Service Commission has not communicated to the petitioner the fate of her said application.
Mr. Sunit Kumar Roy, learned Counsel for the Commission submits that he has received the instruction from his client that the application for general transfer of the petitioner could not be considered as there is no vacancy suitable to accommodate the petitioner in the two schools of her choice.
In view of the above, W.P.A. 22879 of 2022 is dismissed with the above terms without any order as to costs.
