The petitioners claim to be the heirs and legal representatives of a deceased employee of the Eastern Coalfields Limited.

On the death of the employee, an application was made by the widow for grant of employment in favour of her elder son, petitioner no. 2 herein. The elder son of the petitioner was physically examined and he was found medically unfit for employment. Thereafter, application was made for providing employment to the younger son, the petitioner no.3 herein. His application stood rejected by the authority in September 2020 as he was over-aged and could not be provided employment.

The petitioners presently seek Monthly Monetary Cash Compensation. According to the petitioners, the respondent authority ought to provide Monthly Monetary Cash Compensation as employment could not be provided to the heirs and representatives of the deceased employee.

According to the Eastern Coalfields Limited, an application seeking Monthly Monetary Cash Compensation is required to be filed.

Upon hearing the parties, the instant writ petition stands disposed of with the observation that it will be open for the petitioners to apply for Monthly Monetary Cash Compensation. In the event such an application is made, the same shall be considered by the respondent no.7 in accordance with the prevailing National Coal Wage Agreement at the earliest but positively within a period of twelve weeks from the date of filing the application.

The formalities required to be complied with for consideration and subsequent grant of Monthly Monetary Cash Compensation shall be intimated to the heirs of the deceased employee.

In the event the prayer of the petitioners is allowed, then necessary consequential steps shall be taken by the authority without any further delay. 10.
